This past weekend, I had the fortune of sitting down with one of the owners of one of the most successful clubs in town. You know the place. I asked him about the impact of the non-smoking rule and he said it hurt his business 40-75%.
I asked how come and he said it all had to do with vibe. Every time the night picked up, people would head out for a smoke.
To get the injunction, the bar owners would have to prove the matter was:
- urgent
- causes them harm
- they stand to lose more if the anti smoking law stays in place than the city would lose if the ban was lifted
- they have a clear right to complain.
Despite all of the arguments in their favor, the courts did not give them the injunction.
